Lawyers for Freedom: Join the Fight to End the South Dakota Abortion Ban and Restore Reproductive Rights

South Dakota Abortion Rights


For over two years, the fundamental rights of South Dakota women to receive comprehensive reproductive healthcare have been severely restricted. The opposition to restoring women’s rights grows increasingly desperate. Criminalizing standard medical procedures continues to deny women care and places their health and lives at risk.


South Dakota's Abortion Ban


South Dakota has one of the worst rates of violent rape in the nation, and the Attorney General’s published data confirms we’re far from immune to the scourge of incest. Yet, our abortion ban makes no exception for victims of rape or incest.


Maternal health is threatened daily when doctors treating patients experiencing miscarriages (occurring in an estimated 10% - 20% of known pregnancies) can’t provide what they consider proper care because they might be accused of having committed a felony. Couples learning the fetus they’d imagined one day becoming their child won’t survive fetal abnormalities have their grief compounded by facing the choice of leaving the state for care or waiting until the pregnant woman is on death’s doorstep.


South Dakota’s extreme, barbaric abortion law is hurting South Dakota women and girls. It needs to go.


Roe v. Wade is A Reasonable Solution


You probably know that Roe v. Wade was a compromise arrived at by seven Supreme Court justices who were far from radical. USD Law Professor Hannah Haksgaard sumarized Amendment G well in an article by Stu Whitney at the South Dakota News Watch:

The Freedom Amendment parallels Roe v. Wade’s paradigm, offering a balance that aligns with strong public opinion and sound medical practice: unrestricted access to abortion in the first trimester, reasonable regulations protecting women’s health and safety in the second, and allowing abortions in the third to save the life or health of the mother.
